Liability Release Form
This document serves as an agreement and contract between Beak n Wings, Inc, including any and all residents of said boarding home, (hereinafter referred to as “Beak n Wings, Inc”, “we”, “our” or “us”) and the bird owner (hereinafter referred to as “owner” or “the owner”) whose name and signature appear below. This agreement covers the bird or birds listed in the Boarding Contract signed and filed with this document, hereinafter to as “bird”, “bird(s)” or “birds”.
The owner specifically represents that he or she is the sole owner of the bird(s), free and clear of all encumbrances.
By singing this document and leaving their bird with Beak n Wings, Inc., or it’s member, the owner certifies to the accuracy of all information given about the bird on the “Boarding Contract”, “Bird Information form” and “Medical Release” documents.
Beak n Wings, Inc., or it’s member will provide basic care by feeding, watering, cleaning, socializing and obtaining medical assistance (in the event of an emergency) during your bird’s stay at Beak n Wings, Inc., or it’s member.
While it is understood that the bird(s) will be cared for in a responsible manner and it is understood, Beak n Wings, Inc., or it’s member will not be held responsible for the unforeseen; For example, theft, fire, illness (this includes during boarding as well as after boarding).
The owner agrees to pay the rate (as posted in the Boarding Contract) for boarding in effect on each date the bird is in the care of Beak n Wings, Inc., or it’s member.
The owner further agrees to pay all charges for special services requested, and all veterinary costs for the bird during the time said bird is in the care of Beak n Wings, Inc., or it’s member.
The owner assumes any expenses or liability for injuries that they (including anyone accompanying them) or their bird incur while on the property or in the structure used by Beak n Wings, Inc., or it’s member.
All charges incurred by the owner shall be payable upon pick up of bird(s). Beak n Wings, Inc., or it’s member shall have, and is hereby granted a lien on the bird(s) for any and all unpaid charges resulting from boarding or any other services provided by or for Beak n Wings, Inc., or it’s member and our veterinary partners.
Beak n Wings, Inc., and it’s members shall exercise reasonable care for the bird(s) delivered by the owner to Beak n Wings, Inc., or it’s member for boarding. It is expressly agreed by the owner and Beak n Wings, Inc., or it’s members that Beak n Wings, Inc., or it’s member, liability shall in no event exceed the current market value of a bird of the same species of the bird left at Beak n Wings, Inc., or it’s member.
The owner specifically represents to Beak n Wings, Inc., or it’s member that the bird has not been exposed to Psittacine Beak an Feather Disease, Psittacosis or Polyoma within a six-month period to being left for boarding.
While it is understood that Beak n Wings, Inc., or it’s member has taken all reasonable precautions to prevent illness, Beak n Wings, Inc., or it’s member will not be held responsible should the bird become ill during boarding or after boarding. Should the bird become ill after the boarding experience, the owner will notify Beak n Wings, Inc., or it’s member immediately.
In the event Beak n Wings, Inc., or it’s member determines the bird needs to be seen by a veterinarian, every effort will be made to consult with the bird’s owner first. If we cannot reach the owner, we will take the bird to an avian veterinarian at the owner’s expense.
If the bird becomes ill or if the state of the bird’s health otherwise requires professional attention, Beak n Wings, Inc., in its sole discretion, may engage the services of an veterinarian or administer medicine or give other requisite attention to the bird and all expenses thereof shall be paid by the owner.
The owner gives consent to Beak n Wings, Inc., or it’s member to act in the owner’s behalf in obtaining emergency or any employees or volunteers. The owner indemnifies and holds Beak n Wings, Inc., or it’s members harmless for all expenses.
Military personnel will be obligated to pay for two (2) weeks a month (for those who are shipped out) as listed on the fee sheet. You may pay at time of pick up or monthly. All other rules apply.
I, the undersigned, certify that I am the owner of the bird(s) described in the Boarding Contract. I hereby release Beak n Wings, Inc., their officers, agents, representatives, employees and volunteers from any and all liability for the bird(s).
